Abstract

This article examines the principle of justice ('adl) as a foundational pillar of contemporary Islamic economics. Existing literature reveals a persistent conceptual gap between normative frameworks derived from classical Islamic jurisprudence and the operational realities of modern Islamic financial institutions. This study aims to critically analyze how justice is theorized, operationalized, and potentially distorted within contemporary Islamic economic systems. Employing a qualitative library research methodology, this study systematically reviews books and reputable journal articles published between 2019 and 2023. Findings indicate that while justice remains rhetorically central, practical instruments such as profit-and-loss sharing (mudharabah) and joint ownership (musyarakah) have been marginalized in favor of debt-like instruments that replicate conventional financial structures. This study concludes that a critical recalibration of maqashid al-syariah frameworks is urgently required to restore substantive justice in Islamic economic practice.
